Terms of service

These terms of service (“Terms”) govern your use of the Found It Golf website at figolf.com, our stickers and codes, and our related services, including email and text message (SMS) notifications (together, the “Service”). The Service is operated by Found It Golf (“Found It Golf,” “we,” “us,” or “our”). By using the Service, you agree to these Terms and to our Privacy policy. If you do not agree, do not use the Service.
1. The Service
Found It Golf helps golfers and golf courses return lost golf clubs and other items. Owners label their items with Found It Golf stickers or codes. When someone finds a labeled item, they can scan the code or contact us to report it, and we notify the owner or the owner’s golf course so the item can be returned.
2. Eligibility
You must be at least 18 years old to create a Found It Golf account. By creating an account, you confirm that you are 18 or older and able to enter into these Terms.
3. Accounts
You agree to provide accurate, current information, including your name, email address, and phone number, and to keep it up to date. You are responsible for keeping your password confidential and for activity that occurs under your account. Tell us promptly at [email protected] if you believe your account has been used without your permission.
4. Reporting a found item
You do not need an account to report a found item. When you submit a report, you agree that the information you provide, such as your message, your contact details if you choose to give them, and the location where you found the item, may be shared with the item’s owner or the owner’s golf course so the item can be returned. Please provide accurate information and only submit reports about items you have actually found.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harassing, threatening, or fraudulent purpose.
- Submit false reports or impersonate another person, golf course, or Found It Golf.
- Use contact information obtained through the Service for any purpose other than returning an item.
- Copy, alter, or reproduce Found It Golf stickers or codes, or attempt to guess codes that are not yours.
- Interfere with or disrupt the Service, attempt to gain unauthorized access to it, or use automated means to access it without our permission.
6. Your content
You keep ownership of the content you submit to the Service, such as item descriptions, photos, and messages. You grant Found It Golf a non-exclusive, royalty-free license to store, display, and share that content as needed to operate the Service, including sharing it with the owner, finder, or golf course involved in a recovery. You are responsible for making sure you have the right to submit the content you provide.
7. Text messaging (SMS) terms
Program description. Found It Golf sends transactional text messages to account holders who opt in. These are account notifications of two kinds: a one-time code to confirm the mobile number you add, and alerts when someone reports finding one of your items. We do not send marketing or promotional text messages.
How you opt in. You opt in to text messages from your Found It Golf account by entering your mobile phone number, checking the box to agree to receive text messages under these Terms, and confirming your number with the one-time verification code we text to you. The consent box is never checked for you. Agreeing to receive text messages is not a condition of any purchase.
Message frequency. Message frequency varies based on your account activity, such as when you confirm a new mobile number or one of your items is reported found.
Costs. Message and data rates may apply. Contact your wireless carrier for details about your plan.
Opting out. You can cancel text messages at any time by replying STOP to any message from us. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT. After you opt out, we will send one message confirming that you have been unsubscribed, and you will receive no further text messages from us unless you opt in again. You can also turn off text messages in your account settings. To opt back in, reply START or turn text messages back on in your account.

Carrier disclaimer. Wireless carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless carrier and is not guaranteed.
Changing your number. If you change or cancel your mobile phone number, update it in your account or turn off text messages so that messages are not sent to a number that is no longer yours.
Privacy. Our Privacy policy explains how we handle your phone number and text messaging information. We do not sell or share your mobile phone number or text messaging opt-in data with third parties for their marketing or promotional purposes.
8. Fees and payments
Some parts of the Service, such as stickers or memberships, may require payment. Prices and what is included are shown before you buy. Payments are handled by our third-party payment processor. Refunds are covered by our Refund policy.
9. Intellectual property
The Service, including the Found It Golf name, logo, website, stickers, and codes, is owned by Found It Golf and protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Found It Golf does not guarantee that a lost item will be found, reported, or returned, that notifications will be delivered, or that the Service will be uninterrupted or error-free. Finders and golf courses are not employees or agents of Found It Golf, and we are not responsible for their actions, for the condition of any item, or for any arrangement you make with them to return an item.
11. Limitation of liability
To the fullest extent permitted by law, Found It Golf will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of items, data, profits, or goodwill, arising out of or related to your use of the Service. To the fullest extent permitted by law, Found It Golf’s total liability for any claim arising out of or related to these Terms or the Service will not exceed the amount you paid to Found It Golf in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Found It Golf from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Service, your content, or your violation of these Terms or of any law.
13. Suspension and termination
You may stop using the Service and close your account at any time by contacting [email protected]. We may suspend or end your access to the Service if you violate these Terms or if we need to do so to protect the Service, other users, or the public. Sections that by their nature should survive termination, including sections 6 and 9 through 15, will survive.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the “Last updated” date above. If the changes are material, we will give reasonable notice, such as by email or a notice on the Service. Your continued use of the Service after the updated Terms take effect means you accept them.
